The GDPR – General Data Protection Regulation

Introduced in 2018, the GDPR requires any organisation processing personal data (clients, employees, patients, etc.) to ensure its security, confidentiality and compliant disposal.

This regulation:

Strengthens individuals’ rights

(access, rectification, erasure, portability, etc.)

Redefines the concept of “personal data”

including digital identifiers (IP address, cookies, etc.

Holds companies accountable

through self-monitoring, record-keeping and impact assessments

Provides for significant penalties

of up to €20 million or 4% of global annual turnover

Failure to comply with the GDPR can result in severe financial penalties.

The nLPD – New Federal Act on Data Protection (CH)

Since September 2023, the new Swiss Data Protection Act (nLPD) has strengthened data protection requirements and aligns closely with the principles of the GDPR.

It applies to all Swiss companies processing personal data, regardless of their sector or size.

 Key obligations include:

  • Minimisation of collected data
  • Maintaining a record of processing activities
  • Informing data subjects
  • Secure destruction of data at the end of its lifecycle

What is considered “personal data”?

Any information that directly or indirectly identifies a natural person:

First name, last name, personal details

Social security number, bank details

Email address, phone number

HR files, payslips

Health or financial data

IP addresses
